– Verify that the seller of the property is the legal owner.

– Verify whether there are any debts held against the property or any other problems that could affect the sale.

– Make sure that the property has all the necessary licences and authorisations.

– Ensure that the rights of the buyer are protected within the contract.

– Prepare documentation for the signing of the public title deed and arrange appointments.

– Accompany the client to the Notary and verbally translate all legal documents.

– Arrange for the payment of fees and taxes and for the title deed to be registered in the local Land Registry.

– Register the buyer with the Spanish Tax Authorities obtaining the NIE (Número de Identificación de Extranjeros).

Arrange a mortgage or liaise with the bank to coordinate the signing of the mortgage deed.

– Make the final arrangements of the sale and ensure that all documentation and arrangements are to your satisfaction.

– Make sure that all utilities contracts are transferred into your name.

– Ensure that arrangements have been made to enable you to pay the necessary property taxes.

OTHERS SERVICES:

– Request and obtain your N.I.E number or Número de Identificación de Extranjeros, is the Non-resident fiscal identification number, wich identifies you to the Spanish Tax authorities. The number is neccessary for practically any transaction in Spain: buying or selling property, opening a bank account, applying for a mortgage, buying a car, inheritance and payment of Spanish Taxes.

– Power of Attorney: A “general power of attorney” or Poder General, which list all the actions that can be carried out by the holder. These include buying and selling property, apply for NIE numbers, open bank accounts, sign contracts and title deed, apply for mortgages or loans, set up or transfer utility accounts… etc.

– Energy Performance Certificate, (Certificado de Eficiencia Energética):
According to new Law (Decree 235/2013) sellers and landlords are obligated to provide a “Certificate of Energetic Efficiency” of their properties to buyers and tenants, in sales or renting transactions. This certificate, made by official engineers or architects, must identify the use of the energy from the property, classifying the result, and certifying it.
